Plaintiff was a passenger in a vehicle that was stopped and yielding to oncoming traffic in order to turn left from a road onto a private driveway. A second vehicle approached and came to a stop behind the first vehicle. A third vehicle, owned by Phoenix Spirit Group, approached and failed to slow down before crashing into the second vehicle and launching the second vehicle into the rear of the vehicle in which the plaintiff was a passenger. The plaintiff suffered extensive injury to her rotator cuff that required surgery. The defense denied that collision caused the injury to plaintiff’s rotator cuff. Plaintiff’s counsel secured a causation opinion from Joseph Barker, MD. The defense made an offer of judgment of $100,000. The total judgment, including interest and costs, was $279,939.03.
