Harris, Brady Get $2.25M for Moped Driver Hit by Tractor-Trailer

Zachary Harris of Harris Legal and Kyle Brady have secured a $2.25 million settlement for a moped driver hit by a tractor-trailer.
The case involved a moped operator who was struck from behind by a tractor-trailer. The moped operator was thrown from his moped and suffered numerous injuries in the collision, including the traumatic amputation of his finger and a traumatic brain injury. Dash camera video from the crash showed that the moped operator was visible for many seconds prior to the collision, yet the operator of the tractor-trailer was insistent that he never saw the moped rider even after the collision. The Plaintiff contended that the driver began his overnight shift after only about four hours of sleep and was likely using a cell phone at the time of the crash. The cab of the truck was not equipped with a driver facing video camera.
The defense denied negligence and disputed responsibility, contending the moped operator contributed to the incident by failing to wear a proper helmet and by riding on the highway at night. The collision took place on a transition ramp between two roadways, and the parties disputed whether the location of the crash was a controlled access highway.
