Eminent Domain Section
The section strives to educate the public, lawmakers, judges, and members of the bar on the complexities of eminent domain law in accordance with the Fifth Amendment of the U.S. Constitution. Our aim is to better serve our clients and the public by providing a supportive network to our advocate members. Together, we work on cases, provide amicus curiae briefs for important issues on appeal, lobby the legislature, and plans an informative CLE on Land Condemntaion in the Spring – members of the section can attend at a discounted rate. Through the dedication of our advocate members, we have achieved numerous victories, including the recent Map Act decisions that required the payment of fair compensation for the rights unlawfully taken from thousands of North Carolina residents, as well as multiple rulings on the necessity of a valid public purpose. The section offers an active listserv and hosts monthly “Study Hall” sessions to address all your eminent domain inquiries.
