Plaintiff, a 12-year-old boy, was riding his bicycle when he was struck by a car as he attempted to traverse a crosswalk on his way to school in Apex, N.C. The defendant admitted to not having seen the Plaintiff before the collision occurred.
Plaintiff suffered three femur fractures, requiring surgery. He also suffered vertebral fractures. These injuries caused him to miss school for several months.
Defendant Driver’s insurance company agreed to pay the $1 million policy limits after Plaintiff’s counsel filed suit. The recovered money was placed into a court-approved settlement preservation trust.
