Summary

The Medicare Secondary Payer Act (MSP) has been law in place since the early 1980(s). The need to protect Medicare both (1) subrogating their past liens and (2) protecting their future interests is a confusing puzzle. This program will put the pieces of the MSP puzzle together for Law firms to recognize the red flags on their cases and what the best practices/compliance program can be adopted so that your law firm is protected, your client is protected and Medicare is protected. The program will cover how to be a pro-active litigator for your clients by engaging a 3 team approach to compliance. First, educating the client well before settlement; retaining a Liability MSA allocation report and knowing how to use it as a sword to maximize settlements; working with settlement planners and the MSA allocators to deploy strategies to apportion down the MSA post settlement and to engage a MSA Professional Administrator to make sure the client's post settlement new chapter is compliant and successful.
